Hearing Services Program reminds providers about advertising rules

Under subsection 32(3) of the Hearing Services Program (Voucher) Instrument 2019, advertisements or statements about services or devices available through the voucher system must include the phrase “conditions apply under the Australian Government Hearing Services Program”.

Providers must also ensure their advertising does not suggest that fully subsidised hearing devices are provided free of charge by the provider. The subsidy is provided by the Australian Government.

These requirements apply to all advertising and communication channels, including websites, email marketing, commercials and social media.

Providers must also follow other laws that apply to their services under their contract. These include the Competition and Consumer Act 2010 and, where relevant, the Therapeutic Goods (Therapeutic Goods Advertising Code) Instrument 2021.

The Hearing Services Program monitors compliance with its legislative and contractual requirements through its Compliance Monitoring and Support Framework.

Where providers do not meet the requirements, compliance action may be taken. This can include suspension or termination of the service provider contract.
