TGA Takes Legal Action Over Alleged Medicinal Cannabis Advertising Breaches

The TGA has filed proceedings against Better Leaf Pty Ltd, Better Life Aussie Pty Ltd, and their sole director, Mr Jack Weisberg, alleging breaches of the Therapeutic Goods Act 1989.
According to the TGA, the companies advertised medicinal cannabis through their website, social media platforms and printed pamphlets distributed at their dispensary business.
The regulator alleges the advertisements promoted medicinal cannabis for the treatment of serious diseases, conditions and disorders without the required approval. The advertisements also allegedly included restricted or prohibited representations that are not permitted under Australian therapeutic goods advertising laws unless authorised by the TGA.
The TGA further alleges the advertising suggested medicinal cannabis had been approved or recommended by the regulator and included endorsements from current or former health practitioners.
The regulator also claims Mr Weisberg, as the sole director and business manager of both companies, is personally responsible for the alleged breaches.
The TGA is seeking declarations from the Federal Court as well as financial penalties against Better Leaf, Better Life Aussie and Mr Weisberg.
As the matter is now before the Court, the TGA said it will not provide any further public comment.
The regulator has reminded all businesses that advertise therapeutic goods to understand and comply with their legal responsibilities under Australian law.
