TGA Fines Supplement Company for Alleged Illegal Health Claims

The Therapeutic Goods Administration has issued four infringement notices totalling $79,200 to Switch Nutrition Pty Ltd for alleged unlawful advertising of therapeutic goods.

The notices relate to claims made about products containing Nicotinamide Mononucleotide (NMN) and Vitamin D3 (Cholecalciferol), which were allegedly promoted for treating serious medical conditions. These types of claims are not allowed unless specific approval has been granted.

Under Australian law, advertising therapeutic goods directly to the public is tightly controlled. This includes promotion through social media, influencers, or online advertising, and off-label promotion of medicines is also prohibited.

The TGA said such “restricted or prohibited representations” are only allowed in very limited circumstances to protect consumers from misleading claims and to ensure medicines are used safely under medical guidance.

The regulator reminded businesses that they must comply with all legal requirements when advertising, importing or supplying therapeutic goods. Breaches can lead to fines, enforcement notices, or court action.

The action forms part of ongoing compliance and enforcement activity under the TGA’s regulatory framework for 2026 and 2027.
