Company fined $39,600 over alleged unlawful vape sales

The notices were issued to Suryam Energy Pty Ltd in August 2026 after the TGA received reports that vaping goods were being supplied at a service station operated by the company in the Wandandian area.
Following an investigation, the TGA issued two infringement notices. The company paid both notices in full in September 2026.
General retailers, including tobacconists, convenience stores and service stations, are not permitted to sell vaping goods.
Therapeutic vapes used for smoking cessation or managing nicotine dependence can only be supplied through participating pharmacies, where clinically appropriate.
The TGA said it takes reports of suspected non-compliance seriously and may take regulatory action, including infringement notices or civil or criminal proceedings.
The action forms part of the TGA’s ongoing work to identify and prevent the unlawful supply of therapeutic goods and vaping products.
