$2M Penalty for Illegal COVID Test Sales in Australia

The Federal Court of Australia ordered Key Promotional Products Pty Ltd to pay $1.75 million for importing and supplying more than 240,000 unapproved RAT kits between January and March 2022. The court also found the company made over 2,300 false claims that the products were “TGA approved”.
Craig Shane Harding, who managed the company’s daily operations, was fined $250,000 for helping carry out the breaches. Of that amount, $70,000 was suspended on the condition he does not break the law again for 10 years.
The tests were not listed on the Australian Register of Therapeutic Goods and had no approval or exemption to be sold in Australia, making their supply unlawful.
Under Australian law, all therapeutic goods — including medical devices like RATs — must be approved and listed before they can be imported or sold, unless special permission is given.
Anthony Lawler from the Therapeutic Goods Administration said the case shows why strict rules are in place to protect public safety and maintain trust in the system.
The TGA has warned businesses they must follow all legal requirements when importing, supplying or advertising medical products, or face serious penalties including fines or legal action.
