PSR Orders GPs to Repay $27.3 Million Amid Compliance Reviews

The PSR finalised 115 cases last year, with the majority of repayments resulting from negotiated Section 92 agreements, where practitioners voluntarily acknowledged inappropriate practice. Most cases involved partial Medicare Benefits Schedule (MBS) disqualifications, reprimands, or counselling recommendations. Inadequate record keeping and insufficient clinical input were the most common reasons for review.

Thirteen referrals were made to the Australian Health Practitioner Regulation Agency (AHPRA) due to non-compliance with professional standards, while three cases involved suspected fraud. The Determining Authority issued 18 final determinations, with repayment amounts ranging from $10,000 to $1.9 million.

Dr Tony Bayliss, RACGP Medicare Compliance Lead, noted that these compliance reviews affect a very small fraction of Australia’s 50,000 GPs. He emphasised that while repayments and case numbers are trending down, ongoing vigilance in billing practices is essential.

The PSR highlighted an increase in telehealth and telephone services under review, reflecting the growing use of these items. Concerns mirrored those seen in in-person consultations, particularly around insufficient documentation to demonstrate clinical input.

Dr Bayliss encouraged GPs to take any PSR notifications seriously and engage with RACGP programs aimed at supporting safe and compliant billing practices, including guidance for registrars and those on expedited pathways.
