TGA Fines Supplement Company Over Alleged Unlawful Advertising

The company received two infringement notices totalling $37,560, which were paid in December 2025. The action relates to the promotion of sports supplements that were not listed on the Australian Register of Therapeutic Goods (ARTG) and were alleged to contain prescription-only substances.

According to the TGA, the advertised products were alleged to include tryptophan and levodopa, both classified as Schedule 4 prescription-only medicines. Therapeutic goods that are not entered in the ARTG have not been assessed by the TGA for quality, safety, or efficacy and may pose risks to consumers.

Under Australian law, Schedule 4 substances require medical oversight due to potential harms and access restrictions. Decisions about using prescription-only medicines must be made between a health practitioner and a patient, following informed consent. Advertising prescription-only medicines directly to the public is prohibited.

The TGA has reminded businesses that they must understand and comply with their obligations under the Therapeutic Goods Act 1989 before manufacturing, supplying, or advertising therapeutic goods. Failure to comply may result in enforcement actions such as infringement notices, formal directions, or civil or criminal proceedings
